PARTICIPANT AGREEMENT, WAIVER AND RELEASE FORM

I, the undersigned, hereby voluntarily participate in sports, soccer lessons, and all activities associated with the 5 day, 4 night Summer Camp provided by Balance Soccer, LLC (hereinafter referred to as “Balance Soccer"). I acknowledge that my participation may involve various activities, including but not limited to soccer activity, training, and exercise, as well as participation in competitions. I understand that competitions and training sessions carry inherent risks and may involve intense physical exertion and potential contact with other participants. In consideration of Balance Soccer’s agreement to instruct and train me, I, on behalf of myself, my agents, heirs, and assigns, hereby release and discharge Trainer, its respective agents, heirs, assigns, vendors, contractors, and employees from any and all claims, demands, damages, rights of action or causes of action, present or future, arising out of or connected with my participation in this or any activity, including any injuries resulting therefrom.

I understand and acknowledge that the activities provided by Balance Soccer may involve certain risks, including, but not limited to, the following: (1) malfunction or breakage of Trainer's or my own equipment; (2) slip, fall, or dropping of equipment; (3) negligent instruction or supervision. I agree to assume all such risks and expressly release Trainer from any liability arising from such risks.

Furthermore, I understand that there are inherent risks associated with the following specific activities and more that may be present at this camp:

1. Big Hill Slip 'n Slide

2. Playing and floating in and near the creek

3. Swimming in the pool

4. Going up and down the big hill

5. Exploring the forest and navigating its paths by foot

6. Volleyball

7. Basketball

8. Capture the Flag

9. Campfire

10. Wildlife encounters

 

I acknowledge that any sports or exercise, including soccer activities, can be potentially hazardous and may result in injuries or other adverse health effects, such as changes in blood pressure, fainting, heart attack, stroke, serious disability, or even death. I voluntarily participate in these activities and use equipment with full knowledge, understanding, and appreciation of the inherent dangers involved. I agree to assume and accept any and all risks of injury, regardless of severity, or death.

I understand that it is recommended to obtain a physician's consent before participating in any sports, fitness, training, or exercise activities, especially if I have any pre-existing medical conditions or if there is a substantial change in the amount of physical activity performed. I acknowledge that I have the option to consult a physician but have chosen to participate in the sports activities offered by Balance Soccer without obtaining such consent. I assume full responsibility for any risks associated with my participation.

I agree to waive the protection of any applicable statutes that may limit the scope of this release. I understand that this waiver and release of liability extend to all claims, known or unknown, that I may have against Balance Soccer.

I acknowledge that during my participation, I may be photographed or filmed. I grant permission for my name, image, and/or likeness to be used for legitimate purposes by Trainer and its activity holders, producers, sponsors, organizers, and assigns. I understand that if I do not wish to be photographed or filmed, I must inform Balance Soccer in writing before participating in the activity.

This agreement and the rights of the parties shall be governed by and construed in accordance with the laws of the state or jurisdiction where Balance Soccer operates. Any legal disputes arising from this agreement shall be resolved in the appropriate courts of that jurisdiction. The prevailing party in any dispute, including arbitration, shall be entitled to reimbursement of all reasonable expenses incurred, including attorney's fees.

This agreement constitutes the entire agreement between the parties and supersedes any prior negotiations, representations, or agreements. Any provision of this agreement that is deemed unenforceable, invalid, or violates applicable law shall be deemed stricken without affecting the enforceability of the remaining provisions.

I have read this form in its entirety and fully understand that it is a release of liability. By signing this document, I voluntarily waive any right I or my successors may have to bring a legal action or assert a claim against Balance Soccer for negligence or that of its employees, agents, or contractors.

This form is an important legal document that explains the risks involved in participating in soccer lessons, competitions, and training sessions. It is critical that you have read and understand this document completely. If you do not understand any part of this document, it is your ultimate responsibility to ask for clarification prior to signing it.
